Debtor communication charter — how Kenstone Capital speaks to the businesses that owe our clients money.

Our clients' names are on every conversation we have. This is the standard we hold, and the standard you can hold us to.

  1. We act for a client, and we say so. Every communication identifies Kenstone Capital, the client we act for, the amount claimed and the reference. We do not misrepresent who we are or who we act for.
  2. We communicate lawfully. Within the law and the codes that apply to commercial recovery in India. No threats of consequences that are not available; no false urgency; no impersonation of courts, police or government.
  3. We communicate at reasonable hours and through reasonable channels. Working hours on working days, to business contacts, through channels the debtor business uses. We do not contact family members, employees unconnected to the account, or personal social media.
  4. We state the consequence as a process. What will happen if the sum is not paid, and when. Stated calmly, in writing, and then followed through — never as a threat, and never as something we do not intend to do.
  5. We keep a record of every contact. Calls, messages, visits and notices are logged. If a debtor disputes our conduct, the record is the answer, and we will produce it.
  6. We take disputes seriously. A genuine dispute about goods, services or amounts is recorded and referred to the client for resolution. We do not pursue a disputed sum as if it were undisputed.
  7. Field visits are professional. Announced or unannounced as the matter requires, but always by identified staff, at business premises, during business hours, with no disruption to the debtor's operations.
  8. Nothing is filed without the client's approval. Legal action is recommended case by case and taken only on the client's written instruction. We do not threaten litigation we have not been instructed to bring.
  9. You can reach us. A debtor business can contact us to discuss a payment plan, raise a dispute or ask for a copy of the record at info@kenstonecapital.in, quoting the reference on the notice.

This charter applies to every practitioner, field collector and advocate acting on a Kenstone Capital matter. A breach is reportable to info@kenstonecapital.in and is investigated against the record.
